Terms and Conditions for the use of L.ai Circular

These Terms and Conditions (hereinafter "Terms" or "T&Cs") govern the use of the L.ai Circular feature, a platform integrated into the L.ai – Holistic Waste Management solution (hereinafter "L.ai"). By accessing or using the L.ai Circular feature, the user accepts these T&Cs and becomes bound by them. If you do not agree, you must not use the L.ai Circular feature.

1.Purpose of L.ai Circular

1.1L.ai Circular is a digital platform that enables users to offer or receive objects or materials free of charge from other users of the L.ai – Holistic Waste Management solution, as an alternative to discarding them, promoting a sense of community, the circular and sharing economy, as well as the reduction of waste generation, much of which would otherwise end up in landfill.

1.2L.ai Circular operates solely as a digital facilitation and intermediation tool through which users of the L.ai solution may post offers of objects or materials. All exchanges, agreements or transactions that take place outside the application are the sole responsibility of the users.

2.Eligibility and account

2.1Only individuals aged 18 or over may use L.ai Circular. Age is verified by user declaration; Comunidade Ondulante, Lda. is not liable for false declarations.

2.2When creating an offer, the user confirms that the information provided (including contact details and collection locations) is truthful, accurate and up to date.

2.3Comunidade Ondulante, Lda. reserves the right to suspend or terminate accounts in cases of misuse, fraud or breach of these Terms.

3.User responsibilities

3.1The user is solely responsible for the objects they make available, including:

  • Ensuring that the description of the object is truthful and accurate;
  • Ensuring that the object does not pose a risk to safety, health or legality;
  • Ensuring that the object may be lawfully shared or donated under applicable legislation.

3.2The user is responsible for:

  • Arranging collection in a safe and lawful manner;
  • Respecting the privacy and safety of other users;
  • Avoiding abusive, discriminatory or inappropriate behaviour.

3.3The user may not use L.ai Circular for:

  • Commercial or for-profit activities, save where expressly authorised;
  • Sharing prohibited or dangerous objects (for example: hazardous waste, medicines, animals, perishable foods without appropriate safety conditions, weapons, controlled substances, unlawful materials or materials that infringe third-party rights);
  • Infringing intellectual property rights or the rights of third parties.

4.Data processing and privacy

4.1By using L.ai Circular, the user consents to the processing of their contact details and general information about the collection location (municipality, parish and, optionally, neighbourhood), strictly for the purpose of enabling the sharing of objects.

4.2The user understands that, by default, only the contact details provided and the general information about the collection location are visible to other L.ai Circular users when they interact with an offer. The user posting an offer may, entirely optionally, choose to also make the postcode of the collection location visible.

4.3Comunidade Ondulante, Lda. applies security measures in accordance with the GDPR, but cannot prevent other users from misusing data once they have accessed it. The level of detail of the contact information shared is the sole responsibility of the user.

4.4For further details, the Privacy Policy of L.ai – Holistic Waste Management applies, without prejudice to the additional provisions set out in these Terms.

5.Liability and disclaimer

5.1Comunidade Ondulante, Lda. and the L.ai solution act solely as digital facilitators and intermediaries and are not a party to any exchange or agreement between users.

5.2Although the L.ai Circular feature is supported by an advanced artificial intelligence model for detailed image recognition, Comunidade Ondulante, Lda. does not guarantee the verification or validation of:

  • the condition, safety, legality or usefulness of shared objects;
  • the accuracy of descriptions or information provided by users;
  • user conduct during or after exchanges.

5.3All liability for exchanges, including damage, loss, injury or disputes, rests solely with the users involved.

5.4Comunidade Ondulante, Lda. shall not be liable for:

  • Any direct, indirect, incidental or consequential damages arising from the use of L.ai Circular;
  • Any loss of data, reputation or opportunity;
  • Acts or omissions of users or third parties.

Comunidade Ondulante, Lda. shall not be liable for indirect, incidental or consequential damages arising from the use of L.ai Circular.

6.Safety guidelines

6.1Users are advised to:

  • Arrange collections preferably in public and safe locations;
  • Avoid sharing sensitive personal information beyond what is strictly necessary to complete the transaction;
  • Report suspicious activity to Comunidade Ondulante, Lda. immediately at contacto@laiwastesolutions.com;
  • Report any activity that jeopardises their physical, mental or social well-being immediately to the competent authorities.

7.Intellectual property

7.1All intellectual property rights in L.ai Circular (software, brand, interface, content) belong to Comunidade Ondulante, Lda.

7.2Users grant Comunidade Ondulante, Lda. a non-exclusive, worldwide and royalty-free licence to use, display and process the content submitted, solely for the purposes of operating L.ai Circular and promoting the L.ai – Holistic Waste Management solution.

8.Suspension and termination

8.1Comunidade Ondulante, Lda. may suspend or terminate a user's access to L.ai Circular in the event of breach of these Terms or misuse of the feature. Any decision to suspend or terminate access is at the sole discretion of Comunidade Ondulante, Lda., without any obligation to provide justification or prior notice.

8.2The user may cease using L.ai Circular at any time by withdrawing their acceptance of these Terms, deactivating their account or uninstalling the L.ai – Holistic Waste Management application.

9.Changes

9.1Comunidade Ondulante, Lda. may update these T&Cs at any time. Users will be notified of any changes, and continued use of L.ai Circular after such changes constitutes acceptance of the new conditions.

10.Governing law and jurisdiction

10.1These Terms are governed by Portuguese law.

10.2Any dispute shall be submitted to the competent courts of the judicial district of Viana do Castelo, Portugal, save where mandatory legal provisions to the contrary apply, in particular consumer protection legislation.
